Subject: Items left unattended in Parliament Square


Dear Sir and Madam

Thank you for your e-mail of 12 February 2013.


You have stated that members of the campaign have been attending and checking the campaign, notwithstanding the fact that for a number of days the Council’s officers have not observed any persons doing so.  However, I must inform you that even if the items were being checked as you have stated, it is not considered that this would be sufficient to show that the items have not been abandoned.


As I have previously stated, the Council is concerned to ensure that it complies with its statutory duty as highway authority with responsibility for the footway in Parliament Square. In the circumstances, the Council will assume that the items have been abandoned if they continue to be left unattended and will take the necessary steps to remove them.


I should therefore be grateful if you would confirm that you will arrange for all the items to be removed from the footway in Parliament Square by 4 p.m. this Friday, 15th February 2013.  Should the items remain after this date, or continue to be left unattended, they shall be deemed to be abandoned and the Council will take the necessary steps for their removal.


I would also remind you of the provisions of section 143 of the Police Reform and Social Responsibility Act 2011 which enables an authorised officer of the City Council to direct any person in attendance to stop doing a prohibited activity and that should that person fail to comply with such a direction, he would commit a criminal offence and the authorised officer would be entitled to seize the items subject to the direction.

Dear Anghel Pufulete,

Please clarify, your position is:

If we ARE NOT at the site, at the time(s) YOU are choosing, that you will steal the display/property, or

If we DO NOT ‘attend’ the site in person continuously and constantly, 24/7,that you will steal the display/property, or

If we DO ‘attend’ the site in person continuously and constantly, 24/7, that you will steal the display/property, AND prosecute the alleged offence(s), after giving a direction*.

* NB: Further to your previous thefts, allegedly under PRSRA2011, where you have NOT, and are NOT prosecuting for the alleged offence(s).  Please return, as directed in previous email, ALL property stolen (eg Umbrella’s, Blankets, etc.).


To clarify, we confirm the display and ancillary items continue to be in use by us as part of our continuing 24/7 campaign, started on 2nd June 2001, by Brian Haw against the government’s mass murder/genocide, and is thus protected by Art 10, Right to Freedom of Expression, European Convention of Human Rights and Fundamental Freedoms, enacted in primary UK law through Human Rights Act 1998.


I would additionally remind you of Articles 3 , Prohibition of Torture, and 4, Prohibition of Slavery and Forced Labour in relation to your attempts to manage our campaign against our interests.

Your claim that the campaign has not been attended is visibly wrong (see photo, previous email) – are your ‘officers’ blind! Or did you ‘choose’ your times of visibility?

To EXPLICITLY counter your ‘abandonment’ argument:

The items are NOT res nullius.  We have NOT given up our rights and interests in the property.  We ARE continuing to use the display, etc to campaign at a time/times of OUR choosing.

If you wish to challenge this further, we expect a FULL disclosure by you of your reasons/excuses and decisions.  We are happy to invite you to settle such an obviously vexatious claim, in the High Court – we can even offer you the choice of;

a) adding your nonsense to the case of, Barbara Tucker vs Commissioner of police of the metropolis (HQ12X03564) [so, Barbara Tucker vs Commissioner & WCC], and/or

b) Judicial Review, and/or

c) Civil claim against WCC, and others as appropriate.

Of course the proper ‘next step’, is that - if you, regardless of common sense and law, still seriously consider you have any valid argument – you make an application to the court for an order to remove OUR campaign.  But then, you have already, obviously, considered the merits and legal likelihood of success – and found that will never wash (no matter how many Secretaries of State help to nobble high court judges).

Due to the time restriction YOU HAVE IMPOSED, we require you to confirm, by 1200hrs tomorrow 14th February 2013, that you are, either;

a) NOT proceeding with any action

OR

b) If you are, then which of the above we are to proceed on.
We will then be able, if necessary, to file the relevant application(s) at the High Court tomorrow.

Abandonment (Def’n): The act of giving up a legal right, particularly a right of ownership of property.  Property that has been abandoned is res nullius (a thing belonging to no one), and a person taking possession of it therefore acquires a lawful title. An item is regarded as abandoned when it can be established that the original owner has discarded it and is indifferent as to what becomes of it.
